Welcome to Home Alchemy Art.
These Terms of Service (“Terms”) govern your use of our website, customer account features, products, and services, including purchases made through our online store (collectively, the “Services”).
By placing an order, you agree to these Terms. Certain provisions concerning acceptable website use also apply whenever you browse or otherwise use the website.
Nothing in these Terms excludes, restricts, or limits any consumer rights that cannot legally be excluded, restricted, or limited.

1. Scope of These Terms
These Terms apply to purchases made through the Home Alchemy Art online store and to the use of the Services.
The products currently offered through the store are non-personalized physical goods.
If you purchase products primarily for purposes relating to your trade, business, craft, or profession, some statutory consumer rights described in these Terms may not apply to you.
2. Use of the Website
You may use the website only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation, availability, or security of the Services.
You must not:

attempt to obtain unauthorized access to the website, customer accounts, systems, data, or networks;

use the website for fraudulent, unlawful, misleading, abusive, or harmful purposes;
-
interfere with the operation, security, or availability of the website;
-
introduce viruses, malicious software, automated attacks, or other harmful technology;
-
submit unlawful, offensive, infringing, defamatory, or harmful content;
-
impersonate another person or provide deliberately false information;
-
copy, reproduce, distribute, modify, sell, or commercially exploit website content without prior written permission, except where permitted by law.
We may restrict access to the Services where reasonably necessary to protect customers, the website, our business, or third-party rights.
3. Eligibility to Purchase
To place an order, you must:

be at least 18 years old and legally capable of entering into a binding contract, or place the order with the direct involvement and authorization of a parent or legal guardian;

provide accurate, current, and complete information;

provide a valid billing and delivery address;
-
be authorized to use the selected payment method;
-
provide any information reasonably required to process, fulfil, and deliver the order.
By placing an order, you confirm that these requirements are met.
4. Products and Product Descriptions
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, colours, features, availability, and prices are accurate and understandable.
Some Home Alchemy Art products may be handmade, finished by hand, or produced in small batches.
Minor variations may occur because of:

handmade or small-batch production;
-
natural or material characteristics;
-
normal production tolerances;
-
differences between screens and display settings;
-
lighting and photography;
-
slight differences in colour, texture, pattern, placement, shape, or finish.
Such variations do not necessarily constitute a defect or lack of conformity where they do not materially affect the product’s agreed characteristics, quality, appearance, safety, or intended function.
The delivered product must nevertheless conform to:
-
the product description;
-
the selected variant;
-
the agreed quantity;
-
the specifications displayed before purchase;
-
any other binding information forming part of the order.
Products may be modified, discontinued, or temporarily unavailable.
Changes made after an order has been accepted will not affect that order unless:
-
the customer agrees to the change;
-
the change is required by law;
-
fulfilment becomes impossible and the customer is offered an appropriate remedy.
5. Product Availability
All products are subject to availability.
Adding an item to a cart does not reserve it.
Occasionally, a product may become unavailable after an order is submitted because of:
-
inventory errors;
-
simultaneous orders;
-
damage identified during quality control;
-
supplier or production problems;
-
technical errors.
If we cannot fulfil an order, we will notify the customer and refund the amount paid for the unavailable product.
6. Prices, VAT, and Additional Charges
Prices are displayed in the currency selected for the relevant market.
Prices include VAT where applicable, unless clearly stated otherwise.
Before submitting an order, the customer will be shown:

the product price;
-
applicable discounts;
-
shipping charges;
-
applicable taxes collected by us;
-
the total amount payable.
No optional additional charge will be imposed without the customer’s express agreement.
For deliveries outside the European Union, customs duties, import taxes, carrier handling fees, or other charges imposed in the destination country may apply unless checkout clearly states that such charges are included.

7. Payments
Payments are processed through Shopify and the payment service providers displayed during checkout.
Available payment methods may depend on:

the customer’s location;
-
the selected currency;
-
the relevant Shopify market;
-
the payment services currently enabled in the store.
We do not guarantee that every payment method will be available in every country.
Payment information is handled by Shopify or the relevant payment provider in accordance with their own terms and privacy practices.
An order may be refused or cancelled where there is a valid reason, including:
-
payment authorization failure;
-
suspected fraud or unauthorized activity;
-
an obvious pricing or technical error;
-
product unavailability;
-
inability to fulfil or deliver the order;
-
unlawful or abusive conduct connected with the transaction.
If we cancel an order after payment has been received, we will refund the amount paid using the original payment method unless another method is agreed or required by law.
8. Placing and Accepting an Order
Submitting an order constitutes an offer to purchase the selected products.
Before submitting the order, you will have an opportunity to review and correct the information entered during checkout.
An order is accepted when:

payment has been successfully authorized or received; and
-
an order confirmation has been sent by us or through the Shopify system.
We may refuse or cancel an order where there is a valid reason, including where:
-
the product is unavailable;
-
payment cannot be processed;
-
the transaction appears fraudulent or unauthorized;
-
an obvious pricing, product, shipping, or technical error occurred;
-
the delivery address is invalid or unsupported;
-
fulfilment becomes impossible because of circumstances outside our reasonable control;
-
the customer has materially misused the Services.
If an accepted order is cancelled by us, we will notify the customer and provide the refund or other remedy required by applicable law.
9. Order Changes and Cancellation Requests
If you need to change or cancel an order, contact us as soon as possible or use the electronic Request a return or cancellation function available through the link in the store footer.
Cancellation requests may normally be submitted until the relevant order item has been fulfilled.
We will process cancellation requests as soon as reasonably possible.
If fulfilment or dispatch has already begun, immediate cancellation may no longer be technically possible.
This does not remove or restrict any statutory right of withdrawal that applies to the order.
If a dispatched parcel cannot be stopped, the customer may exercise the right of withdrawal and return the goods in accordance with our Refund, Return & Withdrawal Policy.
10. Shipping and Delivery
Available shipping destinations, methods, costs, and estimated delivery periods are described in our Shipping Policy or displayed during checkout.
Unless expressly stated as guaranteed, production, processing, and delivery times are estimates.
Delivery times may be affected by:
-
carrier or postal disruption;
-
customs procedures;
-
local delivery conditions;
-
public holidays;
-
severe weather;
-
incorrect or incomplete delivery information;
-
the customer’s failure to accept or collect a parcel;
-
circumstances genuinely outside our reasonable control.
We remain responsible for fulfilling the order and will provide reasonable assistance where a shipment handled by a carrier selected or offered by us is delayed, lost, or damaged.
For consumer orders, the risk of accidental loss or damage generally remains with us until the goods are physically received by:
-
the customer; or
-
a third party designated by the customer, other than the carrier.
If the customer independently appoints a carrier that was not offered by us, the risk may pass when the goods are handed over to that carrier, to the extent permitted by applicable law.
Nothing in these Terms limits any mandatory rights concerning delayed delivery, non-delivery, lost parcels, damaged parcels, cancellation, or refunds.
11. Right of Withdrawal for EU Consumers
If you are a consumer in the European Union, you generally have the right to withdraw from an online purchase within 14 days without providing a reason.
The withdrawal period generally begins on the day after:
-
you, or a third party designated by you other than the carrier, receive the goods; or
-
in the case of products delivered separately under one order, you receive the final product.
To meet the deadline, it is sufficient to submit a clear withdrawal statement before the withdrawal period expires.
You may exercise the right of withdrawal:
-
through the electronic Request a return or cancellation function available in the store footer;
-
by email;
-
by post;
-
by another clear statement communicated to us.
After notifying us of your decision, you must return the goods without undue delay and no later than 14 days after submitting your withdrawal statement.
Detailed instructions, the return address, the model withdrawal form, and the applicable refund rules are set out in our Refund, Return & Withdrawal Policy.
12. Electronic Return, Cancellation, and Withdrawal Function
The electronic function available through the store footer allows eligible customers to submit requests relating to:
-
cancellation of unfulfilled products;
-
withdrawal from an eligible purchase;
-
return of delivered products.
The customer may be required to verify their identity using their email address or an authentication code and to identify the relevant order.
After the request is submitted, an automatic acknowledgment will be sent by email.
The acknowledgment confirms that the request has been received.
It does not by itself confirm:
-
that a cancellation has already been completed;
-
that a refund has already been issued;
-
that the returned goods have been inspected;
-
the final amount of any refund.
We will process each request in accordance with:
-
applicable consumer law;
-
these Terms;
-
our Refund, Return & Withdrawal Policy;
-
the status of the order.
13. Returning Goods
For a change-of-mind return made under the statutory right of withdrawal, the customer is responsible for the direct cost of returning the goods.
This applies because the customer is informed of that responsibility before purchasing.
We do not routinely provide prepaid return labels for change-of-mind returns.
The customer should package the goods securely and return them to the address specified in our Refund, Return & Withdrawal Policy.
The customer may inspect and handle a product only to the extent necessary to establish its nature, characteristics, and functioning, in the same way that it could reasonably be inspected in a physical store.
The customer may be responsible for diminished value caused by handling beyond what is necessary for such inspection.
The product does not need to be completely unopened or unused merely for the customer to exercise the statutory right of withdrawal.
14. Refunds Following Withdrawal
Following a valid exercise of the statutory right of withdrawal, we will reimburse the payments received for the returned products.
Where applicable, the reimbursement will include the cost of the least expensive standard delivery method offered for the original order.
If the customer selected a more expensive delivery method, we are not required to reimburse the additional cost above the least expensive standard option.
The refund will be made without undue delay and no later than 14 days after we are informed of the decision to withdraw.
For physical goods, we may withhold reimbursement until:
-
we receive the returned goods; or
-
the customer provides evidence that the goods have been sent back,
whichever occurs first.
Refunds will normally be issued using the same payment method used for the original transaction unless another method is expressly agreed and does not create additional costs for the customer.

15. Damaged, Defective, Incorrect, or Non-Conforming Goods
The statutory right of withdrawal is separate from the customer’s rights where goods are:

damaged;
-
defective;
-
incorrect;
-
incomplete;
-
materially different from their description;
-
otherwise not in conformity with the contract.
If you receive such goods, please contact us as soon as reasonably possible.
We may ask for information reasonably necessary to assess the issue, including:
-
the order number;
-
a description of the problem;
-
photographs of the product;
-
photographs of the packaging or shipping label where relevant;
-
other supporting information.
Providing photographs may help us resolve the matter efficiently, but this requirement will not limit statutory rights where providing photographs is impossible or unreasonable.
Where the product is not in conformity with the contract, we will provide the remedy required by applicable law.
The customer will not be required to pursue the delivery carrier directly where we remain legally responsible for the shipment.
16. Statutory Conformity Rights
Nothing in these Terms excludes or limits statutory rights concerning goods that are damaged, defective, incorrect, or not in conformity with the contract.
Consumers in the European Union generally benefit from statutory protection for a lack of conformity that becomes apparent within at least two years after delivery, subject to applicable national law.
Depending on the applicable law and circumstances, the available remedies may include:

repair;
-
replacement;
-
price reduction;
-
termination of the contract and a refund.
Repair or replacement will be provided without charge where required by law, including necessary costs of postage, transport, labour, and materials.
A price reduction or termination may be available in circumstances provided by applicable law, including where repair or replacement:
-
is impossible;
-
would impose disproportionate costs;
-
has not been completed properly or within a reasonable time;
-
would cause significant inconvenience;
-
has failed to bring the goods into conformity.
Statutory conformity rights do not cover problems caused exclusively by:
-
normal wear and tear;
-
misuse;
-
improper handling, care, or storage;
-
accidental damage occurring after delivery;
-
unauthorized alteration;
-
failure to follow reasonable instructions.
This exclusion does not apply where the problem results from a defect, unsuitable packaging, inadequate instructions, or another matter for which we remain responsible.
17. Exchanges
We do not currently offer direct exchanges as a separate process.
If you wish to replace a correctly supplied product with another product, colour, size, or design, you may:
-
return the original product in accordance with the Refund, Return & Withdrawal Policy; and
-
place a new order.
This does not affect the right to replacement where a product is damaged, defective, incorrect, or otherwise not in conformity with the contract.
18. Promotional Offers and Discount Codes
Promotions, discount codes, free-delivery offers, and other special offers may be subject to additional conditions displayed when the offer is made.
Unless stated otherwise:

discount codes cannot be exchanged for cash;
-
only one discount code may be used per order;
-
codes may have an expiry date;
-
codes may be limited to specific products, collections, markets, or customers;
-
discounts cannot be applied retroactively to an order already placed.
Nothing in this section limits mandatory rules concerning price reductions or misleading commercial practices.
19. Intellectual Property
All website content, including:

text;
-
photographs;
-
graphics;
-
product images;
-
designs;
-
layouts;
-
logos;
-
branding;
-
product descriptions;
-
illustrations;
-
software;
-
other materials;
is owned by Home Alchemy Art, licensed to us, or used with appropriate permission.
This content is protected by copyright, trademark, design, and other applicable intellectual property laws.
You may not copy, reproduce, modify, republish, distribute, sell, license, or commercially exploit website content without prior written permission, except where permitted by law.
Purchasing a physical product does not transfer intellectual property rights in:
-
the Home Alchemy Art brand;
-
website content;
-
product photography;
-
artwork or decorative designs;
-
templates;
-
manufacturing or creative processes;
-
other protected materials.
The customer may use the purchased physical product for normal personal purposes, including displaying it or giving it as a gift.
20. Customer Reviews and Submitted Content
If you submit a review, photograph, comment, feedback, or other content, you confirm that:
-
you are entitled to submit it;
-
it is accurate to the best of your knowledge;
-
it does not infringe another person’s rights;
-
it is not unlawful, defamatory, discriminatory, threatening, or misleading;
-
it does not contain malicious software or harmful code.
You retain any rights you hold in the submitted content.
Where you intentionally submit content for publication, you grant us a non-exclusive right to display and use that content for the purpose for which it was submitted.
We will not use identifiable private customer communications, order information, or complaint materials publicly without an appropriate lawful basis or separate permission.
21. Privacy and Personal Data
Personal information is processed in accordance with our Privacy Policy.
The Privacy Policy explains:

what information we collect;
-
how and why it is processed;
-
the applicable legal bases;
-
how information may be disclosed;
-
how long information may be retained;
-
the data protection rights available to individuals.
22. Third-Party Services
Our online store is powered by Shopify.
We may also use third-party providers for:

payment processing;

shipping and delivery;
-
fulfilment;
-
email and customer communication;
-
analytics;
-
advertising;
-
hosting;
-
cybersecurity;
-
technical infrastructure.
Some third-party services may be governed by their own terms and privacy policies.
Nothing in this section excludes or limits our responsibility where we remain responsible under applicable law for:

fulfilment of the customer’s order;

delivery through a provider selected or offered by us;
-
conformity of the products;
-
refunds or statutory remedies;
-
other contractual obligations.
23. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
For consumers, our liability is governed by applicable mandatory consumer protection law.
Nothing in these Terms limits rights or remedies relating to:

delivery of goods;
-
conformity of goods with the contract;
-
damaged, defective, incomplete, or incorrect goods;
-
refunds, repairs, replacements, or price reductions required by law;
-
fraud or intentional misconduct;
-
death or personal injury where liability cannot legally be limited;
-
any other liability that cannot lawfully be excluded.
To the extent permitted by applicable law, we are not responsible for loss or damage caused exclusively by:
-
incorrect, incomplete, or misleading information supplied by the customer;
-
misuse, improper storage, or unauthorized modification after delivery;
-
unlawful conduct by the customer;
-
circumstances genuinely outside our reasonable control.
24. Events Outside Our Reasonable Control
We may not be responsible for a failure or delay to the extent that it is directly caused by an event genuinely outside our reasonable control.
Such events may include:
-
natural disasters;
-
war or civil unrest;
-
government restrictions;
-
widespread transport or postal disruption;
-
major strikes;
-
widespread power, telecommunications, or internet failures;
-
serious disruption of essential third-party infrastructure.
Where such an event affects an order, we will take reasonable steps to:

reduce the effects of the disruption;
-
inform affected customers where appropriate;
-
resume performance as soon as reasonably possible.
If performance becomes impossible or is materially delayed, the customer retains any cancellation, termination, refund, or other rights available under applicable law.
25. Changes to These Terms
We may update these Terms to reflect:

operational changes;
-
changes to the Services;
-
changes to products or sales channels;
-
technical changes;
-
legal or regulatory requirements;
-
changes to service providers.
Updated Terms will apply to future use of the website and future orders from the date they are published.
The Terms applicable to an existing order are generally those in effect when the order was placed.
We will not retroactively change material terms of an accepted order unless:

required by law;
-
necessary to correct an obvious error without unfairly disadvantaging the customer;
-
expressly agreed with the customer.
The “Last updated” date will be revised whenever these Terms are changed.
26. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its lawful purpose without limiting mandatory consumer rights.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland and applicable European Union law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protection granted by the law of the country in which you habitually reside.
Any dispute may be brought before a court having jurisdiction under applicable Polish, national, or European Union law.
Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts of Poland.
