1. Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else’s use of the website.

You must not:

  • misuse the website or attempt unauthorized access to its systems,

  • use the website for fraudulent or illegal purposes,

  • copy, reproduce, or distribute website content without permission.

2. Eligibility to Purchase

To place an order, you must:

  • be at least 18 years old,

  • have the legal capacity to enter into a binding contract,

  • provide accurate and complete information,

  • be authorized to use the selected payment method.

By placing an order, you confirm that these conditions are met.

3. Products and Descriptions

We make every effort to ensure that product descriptions, images, and prices are accurate.
However, minor variations may occur due to:

  • handmade production,

  • differences in screen displays,

  • natural material characteristics.

All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time.

4. Prices and Payments

All prices displayed on the website are in the currency shown and include VAT where applicable.

Shipping costs are calculated separately and displayed at checkout.

We accept payment methods made available through Shopify (e.g. card payments, PayPal, Klarna).
We reserve the right to cancel an order in the event of pricing or technical errors.

5. Order Acceptance and Cancellation

An order is considered accepted once payment is confirmed and you receive an order confirmation email.

We reserve the right to refuse or cancel an order if:

  • the product is unavailable,

  • payment cannot be processed,

  • the order appears fraudulent,

  • incorrect information was provided.

If we cancel an order, a full refund will be issued.

6. Shipping and Delivery

Shipping destinations, methods, costs, and estimated delivery times are described in our Shipping Policy.

Delivery times are estimates only.
We are not responsible for delays caused by shipping carriers, customs procedures, or circumstances beyond our control.

Risk of loss passes to the customer upon delivery to the address provided.

7. Returns, Refunds, and Right of Withdrawal

Customers residing in the European Union have the legal right to withdraw from a purchase within 14 days without giving a reason, in accordance with EU law.

Exceptions apply to:

  • personalized or custom-made products,

  • items that cannot be returned for hygiene reasons once used.

8. Legal Guarantee

Under EU and Polish law, all customers benefit from a 2-year legal guarantee for defective products.

This guarantee does not cover:

  • normal wear and tear,

  • damage caused by improper use or handling.

9. Intellectual Property

All content on this website, including text, images, graphics, designs, logos, and trademarks, is the property of Home Alchemy Art and is protected by copyright and intellectual property laws.

You may not use, copy, or reproduce any content without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Home Alchemy Art shall not be liable for:

  • indirect or consequential damages,

  • loss of profits or data,

  • delays or failures caused by third parties,

  • incorrect delivery details provided by the customer.

Our total liability shall not exceed the value of the order placed.

Your personal data is processed in accordance with our Privacy Policy, which explains how we collect, use, and protect your information and your rights under GDPR.

12. Changes to the Terms

We reserve the right to update these Terms at any time.
Changes take effect upon publication on the website. The “Last updated” date will be revised accordingly.

Continued use of the website constitutes acceptance of the updated Terms.

These Terms are governed by:

  • the laws of Poland,

  • applicable European Union consumer protection laws.

Any disputes shall be resolved by the competent courts in Poland, unless mandatory consumer protection laws provide otherwise.
